Geen octrooi voor uitvindingen van ai-systeem

Volgens de aanvragers zorgen 'achterhaalde' octrooiregels voor onderbenutting van ai (artificial intelligence)

Het Europees Octrooibureau weigert octrooi te verlenen aan twee uitvindingen die volgens de aanvragers zonder menselijke tussenkomst tot stand kwamen via kunstmatige intelligentie (ai). Volgens het bureau moeten uitvinders mensen zijn, blijkt uit de schriftelijke afwijzing.

Zowel in Europa als in de Verenigde Staten buigen octrooiverlenende instanties zich al enige tijd over hoe ze moeten omgaan met uitvindingen door ai-systemen. De huidige regels schrijven voor dat uitvindingen op naam van een persoon moeten staan om in aanmerking te komen voor een octrooi. Bij een octrooiaanvraag kun je dus geen bedrijf, organisatie of algoritme opgeven als uitvinder.

Onterecht en achterhaald
Het is onterecht en achterhaald dat octrooien enkel zijn voorbehouden aan personen, vindt een internationaal team van octrooiadvocaten en wetenschappers. Zij zijn van mening dat ook uitvindingen door ai-systemen een octrooi moeten kunnen krijgen.

Om de instanties tot een beslissing te dwingen, diende het team eind 2018 twee octrooiverzoeken in bij het Europees Octrooibureau in München. De twee uitvindingen schreven ze toe aan ai-systeem Dabus. Dat was in eerste instantie ontwikkeld voor de productie van surrealistische kunst, maar bleek ook bruikbaar voor het ontwerpen van een nauw sluitende voedseltrommel en een opvallende lamp die knippert in het ritme van zenuwactiviteit.

Afwijzing
Tot spijt van het team heeft het Europese Octrooibureau de twee aanvragen afgewezen omdat de uitvindingen niet zijn toegeschreven aan een persoon, maar aan een machine. Volgens teamleider Ryan Abbott, professor in Rechten en Gezondheidswetenschappen aan de universiteit van Surrey (Engeland), zorgen de huidige octrooiregels ervoor dat ai onvoldoende wordt benut. Hij hoopt dat de regels worden aangepast zodat ai-systemen in de toekomst ook als uitvinder kunnen worden aangemerkt.

KVK Business Challenge Hi-tech: HTC parking & security - Electronic Checkpoint

Are you a startup, scale-up, self-employed or an SME? The Dutch Ministry of Defence wants to develop an unmanned vehicle access control and needs the help on the final, remaining elements needed for the creation of this system in the field of sensors, data analysis and IT measurement techniques.

To do so, the Chamber of Commerce organises in collaboration with Holland Instrumentation and InnovationQuarter a 'KVK Business Challenge Hi-Tech'. Amongst the challenges (that are open from 1 November - 1 December 2018) is a HTC Parking & Security Electronic Checkpoint.

HTC business challenge in relation to ministry of Defence
This Electronic Checkpoint has been realised physically but remains without an electronic component where specialised SMEs are needed for. An unmannned vehicle access control would allow employees with the Ministry of Defence to stay out of harm's way when vehicles are being controlled. This can be extended to include routine processes that can be automated.

The questions that require answers and innovative solutions include:
    KVK Business Challenge Hi-tech:  HTC parking & security - Electronic Checkpoint
  • How can we identify vehicles, individuals and loaded goods?
  • How can we affirm whether or not vehicles and individuals are authentic?
  • How can we inspect vehicles on potential dangers such as explosives?
SMEs who specialise in sensors (both software and hardware), data analysis and IT and measuring techniques are looked for to complete this assignment, set out of by the Dutch Ministry of Defence. You will share your thoughts and ideas and make additions in the form of questions to display yourself as the best partner to cooperate on this challenge. On 1 December the involved corporate organisation will select the SMEs they wish to cooperation innovatively.
